1. Acceptance of Terms

This agreement (TOS) becomes effective immediately upon your registration for any service provided by Pokhara Host. If you do not agree to the terms herein, you must immediately cease use of the Services.

2. Account Responsibilities

• **Eligibility:** You must be 18 years of age or older to enter into this agreement.
• **Accuracy:** You guarantee that all information provided during registration (contact details, payment information) is accurate, current, and complete.
• **Security:** You are responsible for all actions taken under your account. You must protect your passwords and notify Pokhara Host immediately of any unauthorized use.

3. Payment, Billing, and Service Renewal

• **Billing Cycle:** Services are billed on a recurring basis (monthly, annually, etc.) as agreed upon during purchase.
• **Non-Payment:** Failure to pay fees by the due date will result in the suspension of service. Services will be permanently terminated after a grace period, leading to data loss.
• **Refunds:** All fees are generally non-refundable unless a specific product is covered by an explicitly stated Money Back Guarantee or Refund Policy.
• **Local Payments:** We facilitate payments through local platforms including **eSewa, Khalti, FonePay**, and bank transfers for convenience.

4. Acceptable Use Policy (AUP) and Content

You agree to use our services only for lawful purposes. Prohibited uses include, but are not limited to, the following:

• **Illegal Content:** Distribution or hosting of copyrighted material, fraudulent schemes, or any content violating local or international laws.
• **Unsolicited Email (SPAM):** Sending bulk, unsolicited commercial emails.
• **Abuse:** Engaging in hacking, phishing, distribution of malware, or any action that compromises the integrity or security of our infrastructure or other users' data.
• **Resource Misuse:** Running processes that overburden the server or consume excessive CPU/Memory/Disk I/O resources on shared environments.

Violation of the AUP is grounds for immediate termination of service without refund.

5. Data and Backups

While Pokhara Host takes reasonable precautions to ensure data integrity, **you are ultimately responsible for backing up your own data**. Pokhara Host makes no guarantee that backups will be available or complete and is not liable for data loss under any circumstances.

6. Service Interruption and Limitation of Liability

Pokhara Host is not liable for any damages, whether direct, indirect, incidental, or consequential, arising from the use or inability to use the services, including, but not limited to, loss of data, loss of profits, or service interruptions. Services are provided **"as is"** without warranty of any kind.

7. Indemnification

You agree to indemnify and hold Pokhara Host harmless from any claims, liabilities, damages, and expenses, including reasonable attorney's fees, arising out of or related to your use of the Services, including any violation of the AUP or other policies.

8. Amendments

Pokhara Host reserves the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to the website. Your continued use of the Services constitutes acceptance of the modified TOS.
